Bennet focuses on matters involving fraud and other commercial torts, election law, civil claims arising from alleged criminal misconduct (e.g., revival statute claims, Trafficking Victims Protection Act claims, etc.), contract disputes, restrictive covenants, and creditors’ rights. He has significant trial, appellate, and post-judgment experience. Additionally, Bennet has considerable ADR experience, including mediation, arbitration, and independent claims programs.

  • Represented Ivanka Trump in a lawsuit filed against her by New York’s Attorney General. The Appellate Division (First Department) dismissed all claims against Ms. Trump.
  • Represented Nassau County in redistricting litigation.
  • Obtained an over $28 million judgment for an institutional asset manager in a fraud lawsuit against an alternative lender.
  • Represented Newsmax in a defamation lawsuit brought against it by a voting technology company. After obtaining numerous favorable court rulings for Newsmax, including the dismissal of the plaintiff’s punitive damages claims, Newsmax resolved the matter through a confidential settlement.
  • Represented the co-executors of the Estate of Jeffrey E. Epstein in dozens of lawsuits filed in various federal and state courts — many asserted pursuant to the New York Child Victims Act (CVA) and The Trafficking Victims Protection Act (TVPA) — as well as in connection with the establishment of an independent claims resolution program, and, separately, a comprehensive structured mediation process.
  • Served as trial counsel to the petitioners in the high-profile New York redistricting case Harkenrider v. Hochul. Petitioners prevailed at trial, the Appellate Division (Fourth Department), and the Court of Appeals.
  • Served as counsel for a nationwide book distributor in a federal jury trial involving breaches of personal guaranties and fraud, resulting in judgment of more than $29 million in favor of our client.
  • Represented a global insurance brokerage and risk management services firm in connection with restrictive covenants disputes.
  • Represented the special assets group of one of the largest U.S. commercial banks in various judgment enforcement actions arising from defaults across an approximately $1 billion portfolio of loans to the taxi industry, including CPLR Article 71 seizure actions and CPLR Article 52 turnover proceedings.
  • Obtained a unanimous New York State appellate court (First Department) decision affirming a trial court’s dismissal of a fraudulent inducement action against the directors and officers of a foreign company. The First Department clarified legal principles concerning fraud claims under New York law.
  • Defended a national bakery chain against a proposed Fair and Accurate Credit Transactions Act (FACTA) class action. The Court of Appeals for the Second Circuit, applying the U.S. Supreme Court’s landmark Spokeo decision, found the plaintiff lacked standing to sue.
