JPMorgan Job Seeker Loses FCRA Background Check Suit
Alan Wingfield, Meagan Mihalko, and John Lynch were mentioned in an October 7 Law360 article for their representation of JPMorgan Chase Bank. In a putative class action, the plaintiff alleged that JPMorgan Chase failed to comply with the Fair Credit Reporting Act when it conducted FBI background checks on its employment and contingent worker applicants. Arizona's U.S. District judge granted summary judgment finding that the Fair Credit Reporting Act did not apply to JPMorgan Chase’s FBI background checks because the FBI background checks were not consumer reports prepared by a consumer reporting agency under the FCRA.
