Atlanta attorneys help Suntrust Banks enforce arbitration agreements
Litigation section chief and Atlanta partner Bill Withrow, Class Action Litigation practice group leader and Atlanta partner Lynette Eaddy Smith and Atlanta associate Lindsey Mann were mentioned in a March 1 Thomson Reuters News & Insight article about Suntrust Banks being allowed to use a clause in its contracts with account holders to force them to arbitrate disputes over bank overdraft fees.
The clause, which prohibits account holders from being part of a class action against the bank, was deemed grossly unfair to consumers by a district court in 2010; however, an Atlanta-based U.S. Court of Appeals for the 11th Circuit overturned that decision and upheld the arbitration agreement. The trio represented SunTrust during the court proceedings.
