“Utilities want to know when the EPA will finalize its regulations on coal combustion byproducts and which rules will be put in place. Doug Henderson, partner with Troutman Sanders, says regardless of when or what proposal EPA finalizes, one thing is certain: Coal ash standards at the state and federal levels are coming in light of the December 2008 coal ash spill at the Tennessee Valley Authority Kingston plant.
"On May 4, the EPA announced proposals to regulate the disposal of coal combustion waste from U.S. power plants. The agency offered different possible plans: one that would regulate coal as a "special waste" under Subtitle C of the Resource Conservation and Recovery Act and another less stringent proposal to regulate ash under Subtitle D of the RCRA. ..."
