The presentation will address the attorney-client privilege, the work product doctrine, and waiver of each.
- The section on attorney-client privilege will cover the following:
- When the privilege attaches and specifically who is in the control group; o When in-house attorney communications are covered;
- Practical tips for maintaining confidentiality; and
- That the primary purpose of the communication must be giving legal advice.
- The section on the work product doctrine will cover the following:
- How to determine when something is prepared in anticipation of litigation;
- Whether and when it extends to work created by non-lawyers; and
- The difference between opinion work product and ordinary work product.
- The section on waiver will cover the following:
- Who is authorized to waive;
- The scope and extent of the waiver; and
- Exception for disclosure to certain third parties.
