Clients in the market for legal services often in a process to select counsel. A company decides it is time to sell and interview certain law firms it uses, and it issues a Request for Proposal. You are asked to participate in the process and, if you are selected as a counsel, all it well. But, what happens in the event you are not successful? Can you undertake the transactional matter for a potential buyer of the same company? Can you be local counsel for a party suing the same corporation that issues the RFP? This session will address these questions by exploring the facts presented in a multi-part hypothetical which mirrors various stages of the solicitation process. The recent opinion by the American Bar Association Standing Committee on Ethics and Professional Responsibility also suggestions to mitigate the risks of dealing with prospective clients.
