The U.S. Environmental Protection Agency is on track to begin regulating greenhouse gas emissions under the Prevention of Significant Deterioration and Title V permit programs beginning on January 2 of next year. EPA will begin phasing in GHG regulation in a series of steps that will progressively capture more and more facilities.
Prospective GHG regulation creates a dilemma for business because it has never been done before. Under the PSD program, facilities will be required to undertake Best Available Control Technology, but no one knows at this point exactly what those BACT requirements will be. EPA says it will be issuing guidance by the end of this year, but the guidance may be general and, in any event, states will be required to apply BACT on a case-by-case basis.
As we move within six months of commencement of GHG regulation, it is important for companies to begin planning for how GHG regulation will affect their facilities and what kind of compliance strategies will be necessary. We have assembled an expert group of federal and state regulators, lawyers and technical consultants to help companies to understand the regulation that is coming at them and the strategies they will need to develop to get ahead of the regulatory curve.
