The acquittal was the fourth loss for the DOJ's Antitrust Division in criminal cases over alleged deals to fix wages or restrict recruitment and hiring. A. Christopher Young, a partner at Troutman Pepper, told Law360 that judges and juries "seem to recognize" that no-poach agreements could have lawful goals, but the Justice Department's losses have not slowed down its pursuit of such cases.
"While the decision establishes that a mere understanding with another employer about hiring employees does not give rise to criminal antitrust liability, businesses and HR professionals should be extremely careful about any interactions they have with third parties about their employment practices," Young said. "The DOJ's enforcement actions are very much aligned with the Biden administration's stated policy of protecting employees from what it perceives to be unreasonable restraints of trade."
