Troutman Pepper Partner Matt Adler Authors Second Edition of 'Arbitration: Cases, Problems, and Practice' Law School Textbook
PHILADELPHIA – Troutman Pepper Partner Matt Adler has authored the second edition of his law school textbook, “ Arbitration: Cases, Problems, and Practice,” which presents current case law and real-world practice pointers to teach future attorneys how to win their arbitration cases from the earliest procedural stage. The book explores the three phases of an arbitration and guides students through an actual arbitration from start to finish, including the organizational conference, discovery issues, and third-party and expert witness testimony.
Notably, the second edition, published by Carolina Academic Press, covers numerous legal and societal changes in the past five years that are unique to any other arbitration casebook on the market, including:
- the ongoing legal and political debate on class action bans in arbitration clauses, which raises fundamental access to court issues, including the seminal 2018 SCOTUS decision in Epic Systems;
- the impact of the #MeToo movement on arbitration clauses in sexual harassment cases;
- the continued battle over arbitrator diversity, spearheaded by entertainer Jay-Z’s 2018 petition alleging discrimination in the American Arbitration Association’s arbitrator rosters;
- the chaos created by the ambiguous “manifest disregard” standard—does it allow for appeal of arbitration awards?—and how the New York courts dealt with this issue; and,
- the new "Prague Rules" in international arbitration by which Eastern European and Russian lawyers advocate for less discovery and more arbitrator control.
The book has been developed and “road tested” by Adler’s students over the past 15 years of teaching at law schools. Adler is currently on the faculty of the George Washington University Law School and has previously taught at Rutgers and the University of Virginia.
With more than 30 years of experience as a practicing attorney and law professor, Adler is a trusted authority in the arbitration space.
