VW, Kirkland Face DOJ Push for Individual Prosecutions
Atlanta partner Doug Henderson was quoted in an October 1 Law360 article about Kirkland & Ellis facing the task of defending Volkswagen after the company admitted to using software designed to adjust emissions tests. According to the article, the VW case is one of the first major corporate events to occur since the U.S. Department of Justice indicated it was revising its guidelines for individual accountability for corporate wrongdoing.
“The rules of the game have changed, and the lawyers representing Volkswagen will be some of the first to interpret what that DOJ … [new prosecution policy] means,” Doug said.
