Given the ubiquitous nature of smartphones, laptops and tablets in today's workforce, mobile devices may serve as potential sources of relevant data in discovery. Documents, texts messages, and even photos stored on such devices may have an impact on litigation outcomes. This Program will focus on legal and technical issues related to the obligations, risks, and benefits associated with discovery of mobile devices (including the impact of BYOD policies). We will also discuss broader themes of negotiating the risks, benefits and burdens of discovery of sources that may present unique challenges, with a focus on balancing both burdens and benefits to reach the right result in a specific case.
