Capital One Wins Bid to Ax Its Own Antitrust Appeal
Richmond partners Robert Angle and Dabney Carr were mentioned in this April 7 Law360 article about the Federal Circuit on April 7 granting Capital One Financial Corp.’s motion to dismiss its cross-appeal of the dismissal of antitrust counterclaims against Intellectual Ventures Management LLC, so it can pursue them in district court.
Three days earlier, Intellectual Ventures challenged the related counterclaims in Maryland, “saying it would waste judicial resources by forcing a second district court to resolve a set of legal issues that had already been fully briefed before the federal appeals court.” Capital One, however, stated “it no longer needed the appeal of the Virginia court’s dismissal of its antitrust claims that Intellectual Ventures monopolized the market for banking technology patents because it can now make that argument in Maryland.”
Robert and Dabney are working as legal counsel for Capital One in this complicated and multi-faceted case.
