Troutman Pepper Defends Leading Food Company Against Price-Fixing Conspiracy Claims

For several years, Troutman Pepper has represented a leading food company in multidistrict litigation, pending in federal court in California. The case includes 46 direct and indirect purchaser class and individual direct purchaser actions. Plaintiffs allege that our client conspired with other food manufacturers to reduce the package size and fix prices for packaged tuna in the United States between 2004 through the present. After substantially reducing the scope of plaintiffs’ original claims, we filed a motion for summary judgment motion directed to the remaining price-fixing claims against the company. In April 2023, the court granted summary judgment and eliminated all remaining claims as to our client. Most recently, our client defeated the plaintiffs’ motion for reconsideration of and a motion to certify for appeal the summary judgment award in our client’s favor.
