ATLANTA – Troutman Pepper Locke secured a preliminary injunction from the Chatham County Superior Court on behalf of the Chatham Area Transit Authority (CAT) to maintain its board’s independence and structure.
CAT has been involved in a significant legal battle with the Chatham County Board of Commissioners, seeking to maintain its board structure as defined by House Bill (HB) 756. In early September, CAT initiated a lawsuit against the county commission to prevent them from gaining control over its independent board.
The Troutman Pepper Locke team representing CAT, led by partner David Dove, has been diligently working to uphold HB 756, which restructured CAT’s board and reduced the county’s control. Their efforts were rewarded when the Chatham County Superior Court granted a preliminary injunction, preserving the current board structure while the case proceeds.
“This preliminary ruling preserves the status quo, so riders should take confidence in the fact there’s not going to be any leadership changes or any uncertainty about CAT during this lawsuit,” David explained.
Savannah Alderman Detric Legget, chairman of CAT’s board, testified that any transition of the board’s structure could lead to operational disarray, affecting riders and employees. This testimony contributed to the court’s decision to side with CAT, recognizing the potential for widespread disruption.
As the legal proceedings continue, no further court dates have been set. The outcome of this case will be pivotal in determining the future governance of CAT and its ability to meet the needs of its ridership without interference.
