A Delaware bankruptcy judge confirmed the Chapter 11 plan of the electric vehicle maker on March 5, 2024, over the objections of the Office of the U.S. Trustee and a vocal shareholder. The plan was supported by Troutman Pepper’s client.

The multidisciplinary Troutman Pepper team, led by partners Deborah Kovsky-Apap and Francis Lawall, along with partners David M. Fournier, Sean McNally and Casselle Smith and associate Tori L. Remington, played a pivotal role in the hard-fought case. The team’s deep knowledge and strategic guidance across bankruptcy, securities law, automotive, and EV technology, helped achieve a largely consensual plan that will provide a 100% recovery to unsecured creditors.
