Misha Tseytlin, attorney for Rudisill and head of the appellate and supreme court practice group at Troutman Pepper Hamilton Sanders LLP, said “life-changing benefits” are at stake for veterans in the statutory interpretation case.

“The Montgomery program offers you a monthly stipend. … [With] the post-9/11 program, that’s a full ride. That’s a life-changing opportunity that Congress intended to award to these veterans who serve in wartime, which the VA for a long time now has been denying them incorrectly,” Tseytlin said.

Tseytlin said he was gratified that the Supreme Court took up Rudisill’s case even in the absence of a circuit split: “I think it was the recognition of the importance of this case, to not only veterans, but the longest-serving veterans, those that served two or more periods of service,” Tseytlin said.
