With state courts deciding the “covered person” and “countermeasure” issues, there’s a risk of disparate rulings and “not having a consistent uniform body of law the way you may have if it’s being done by federal courts,” said Callan G. Stein of Troutman Pepper, who represents health care providers and facilities.

Jan P. Levine, also of Troutman Pepper, echoed the point, saying inconsistent court opinions and a lack of clarity in the law is always worrisome.

“When you’re advising a client as to the law and to have the law not clear, it’s always a problem,” said Levine, who also represents health care industry clients.
