The panel will discuss how State Attorney General (State AG) investigations and civil enforcement actions differ from commercial litigation, and from civil and criminal investigations and enforcement actions by the federal government. The discussion will cover the structure of a State AG office, explore the State AG ecosystem, outline the roles of the different divisions in a State AG office, and delve into the unique world of multistate State AG litigation in the life sciences industry. Our panelists also will discuss State AGs' use of outside counsel and the procedures for navigating the settlement and litigation of disputes with State AGs, including recommendations for how to identify State AG goals, how and when to meet with the State AG's office, and the different discovery tools available in State AG litigation (including FOIA requests). Our panelists also will discuss lessons learned from their experiences in the State AG space, the nuances created by the fact that the State AG typically is an elected position, and how changes within a State AG office can affect the direction and pace of both investigations and litigation.
