Air & Climate Report: July 2021
As the dog days of summer unfold, the normal pace of life seems to have slowed a little. In keeping with the season, perhaps, things are relatively quiet on the air regulatory front at EPA. Nonetheless, EPA's spring regulatory agenda, as discussed in this quarter's Air & Climate Report, promises that new regulatory actions are brewing, much like summer's late afternoon pop-up thunderstorms.
This doesn't mean that all is quiet when it comes to air and climate-related issues. This quarter's edition spotlights EPA's rescission of procedural rules adopted by the previous administration that directly impact its rulemaking authority, a recent court decision expanding the scope of a CERCLA exemption for air releases, and Congress's own foray into the rulemaking arena via its Congressional Review Act authority, as well as one state's efforts to bring more certainty to the role of environmental justice in air permitting.
