Dallas Partner Brad Weber, Co-Chair of Locke Lord’s Antitrust Practice Group, was quoted by the National Law Journal on the Federal Trade Commission’s (FTC) continued efforts to identify and warn companies that may have imposed customer restrictions on the use of third-party repair providers for products covered by company warranties. Earlier this month, the FTC warned eight companies that their warranty statements need to be corrected to protect consumers’ Right to Repair.

Weber explains the letters assert that the companies’ warranty language could violate the Magnuson-Moss Warranty Act and observes “that the FTC is looking at these issues and putting companies on notice that they can’t condition the warranty on using approved parts or service providers.”

“The FTC’s priority is to ensure that anyone who purchases a piece of equipment has the right to repair that equipment using a service that may not be an authorized repair provider,” Weber adds, and also notes “that authorized repair service fees and costs are often higher than other repair shops.”
