Richard Reibstein, co-head of management-side firm Troutman Pepper Locke LLP’s independent contractor compliance and misclassification practice, also said high-profile settlements with gig companies have a limited impact.

“Sometimes the settled amounts seem like high figures, but there are often tens or hundreds of thousands of workers sharing the settlement amount,” he said. “Certainly these types of lawsuits will continue, but they have produced a lot less for app workers than has been accomplished through legislative initiatives at the state and local levels.”

Troutman’s Reibstein said state attorney general actions are likely to continue, but also that they do not seem to be influencing consumer behavior.

“When a service is used frequently by consumers, they tend to disregard picket lines and protests,” he said.
