“The administration stuck to their guns. The final rules pushed back some of the most onerous requirements until 2030-32, the end of the implementation period, but there was enormous pressure to liberalize the final rules in a way that did not happen,” Troutman Pepper Hamilton Sanders LLP partner Dan Anziska said. “This accepts there will be a mix of gas-powered, hybrid and pure EVs over the next decade. But to comply, OEMs [original-equipment manufacturers] will need to majorly ramp up EV production.”

“There are more announced projects, and OEMs are making massive investments in batteries and supply chains, but there is little give on the timeline — everything needs to work correctly to move production over here from Asia,” said Anziska of Troutman Pepper, who added that increased private investment — along with robust government grants and loan programs under both the Bipartisan Infrastructure Law and the Inflation Reduction Act — are “moving the needle.”
