Yoon’s attorneys said the VA has advanced a frivolous interpretation of the high court’s Rudisill decision while offering no real defense for its denial of earned educational benefits.

Timothy McHugh, a Troutman Pepper Locke LLP attorney helping to represent Yoon, told Law360 on Friday that the Veterans Court ordered VA Secretary Douglas A. Collins to file a brief within seven days addressing the likelihood that Yoon will succeed on the merits based on the court’s decision in the Perkins case.

The Rudisill decision likely affects more than 1.5 million veterans, according to Mary Grace Metcalfe, another Troutman attorney representing Yoon.

“The question of whether our longest-serving veterans should receive the full benefits to which Congress has entitled them I hope will be resolved for Independence Day,” Metcalfe told Law360 Friday. “We’ve been ordered to respond in seven days, and if this went off with some fireworks, I would not mind.”
