  • Troutman Pepper Locke partner Agustin Rodriguez said that the hemp standard may still change course. “There is always this possibility that forces in Congress will attempt to change this, so we have until November of next year to see if something could arise at any point along the way between now and then.” Rodriguez added that companies should balance compliance preparation with the possibility of further change during the interim.
  • Higher-potency products can also carry secondary consequences. Troutman Pepper Locke’s Rodriguez added that companies entering the cannabis market must be mindful that doing so may affect their banking relationships. 
  • “It doesn’t necessarily create a showstopper for them, but it could. Find the banks that will work with you, work with them, and be aware they may charge you more,” he said.
