David Kupetz will participate in the Financial Lawyers Conference 2022 Nuts and Bolts: Fundamental Issues Arising in Bankruptcy Cases, Article 9 of the Uniform Commercial Code, and Appellate Advocacy on October 6-7, 2022. David’s session will discuss Options for Distressed Debtors and Their Secured Creditors on Thursday, October 6 at 9:50am PDT.
His session will take a step back and examine options that exist for debtors and creditors when a company is distressed. When a business client reaches out to you because it is facing financial distress –maybe it’s a general decline in revenues or increase in expense, or an impending real property foreclosure or personal property sale by a secured creditor, or an imminent judgment – what alternatives are available? What should professionals ask and consider when evaluating recommendations to provide to the client? When is chapter 7 the best option? Chapter 11? Receivership? An assignment for the benefit of creditors (and generally how to do those work)? Which of these alternatives might the lender want as part of a work-out, and why?
This “nuts and bolts” program is designed for insolvency professionals who are not yet experts in their fields, either because they are relatively new to practice or do not deal with these issues routinely. Professionals who are lawyers, financial advisors, bankers, and professionals for private lenders, hedge funds, private equity funds, investors, and companies who participate in debt transactions, will benefit from this program.
