Glenn Pudelka, a partner in Troutman Pepper Locke’s Boston office who specializes in intellectual property and entertainment law, noted that, given the dozens of copyright lawsuits that have already been filed within the last few years, the legal community may be wondering: “Why now?”

He speculated that one reason Disney and Universal may have been sitting on the sidelines was their own interest in using AI for content creation. The studios may also have been waiting to see where the Copyright Office landed in its position on fair use and AI large language models in its latest pre-publication report, he said.

“I think that everybody’s … waiting with bated breath, and I think the report helps,” he said. “So I think now we’re just going to have to wait and see, and get your popcorn ready.”
