Justices Pass On $371M Antitrust Suit Against Time, Hearst
Dan Anziska, Robert Angle and Kevin Wallace were mentioned in a Law360 article titled, “Justices Pass On $371M Antitrust Suit Against Time, Hearst.” The attorneys represented Bauer Publishing Co. in a decade-long antitrust suit by now defunct magazine wholesaler Anderson News LLC. Bauer, as well as other magazine publishers, including Time and Hearst, were alleged to have perpetrated a group boycott aimed at putting Anderson News out of business. The U.S. Supreme Court refused to hear the case, cementing “a Second Circuit ruling in August finding that Anderson News LLC hadn't given sufficient evidence to demonstrate that Time Inc., Hearst Communications Inc. and other magazine publishers illegally conspired to put Anderson out of business.” Commentators have hailed this case as providing importance guidance on how an industry can react and communicate with each other regarding a change in distribution or other industry reorganization to address financial challenges.
