Misha Tseytlin, leader of Troutman Pepper’s Appellate + Supreme Court Practice Group, was quoted in the November 15, 2023 New York Law Journal article “NY Court of Appeals Weighs Second Take for Congressional Redistricting.”
Misha Tseytlin, the lawyer for a group of intervenors who won the related Harkenrider case, said a 2014 constitutional amendment that led to the creation of the IRC had the primary goal of avoiding political gerrymandering.
Tseytlin said mid-decade redistricting by the legislature, regardless of the IRC’s involvement, is a “worst-case scenario.”
“That’s a recipe for another festival of gerrymandering, and the most dangerous kind, when they know where the incumbents are,” said Tseytlin, who added that Democratic lawmakers waited to see where the close Republican races were, and targeted individual members of Congress to make sure those districts weren’t competitive.
Tseytlin said that eliminating last year’s map could lead to more litigation and “another fiasco” that’s “entirely unnecessary.”
