  • Matt Berns, former chief counsel to the New Jersey attorney general (AG) and deputy chief counsel to the New Jersey governor, and previously a trial attorney with the U.S. Department of Justice, has joined Troutman Pepper Locke’s Regulatory Investigations, Strategy + Enforcement (RISE) practice and nationally recognized State AG team.
  • As chief counsel to the New Jersey AG, Berns oversaw the Divisions of Law, Consumer Affairs, and Civil Rights and served as the AG’s most senior adviser on noncriminal matters. In that role, he directed civil litigation and investigations across a wide range of issues, including antitrust, consumer protection, data privacy and cybersecurity, environmental law, false claims, professional licensure, securities fraud, and worker protections. As deputy chief counsel to the New Jersey governor, Berns oversaw the office’s litigation, rulemaking, executive order, clemency, and oversight functions, and advised on pending legislation.
  • At the Federal Programs Branch of the U.S. Department of Justice’s Civil Division, Berns defended the federal government in cases challenging the constitutionality of statutes and the legality of agency rules and policies. His work included litigation addressing the constitutionality of the Consumer Financial Protection Bureau (CFPB) and some of the CFPB’s earliest regulations, as well as numerous lawsuits involving the Medicaid and Medicare programs.
