David Anthony, a partner in Troutman Pepper Locke’s Privacy + Cyber Practice Group, was quoted in the January 2, 2026 Law360 article, “Privacy & Cybersecurity Litigation to Watch in 2026.”

“The last few years have seen a wave of cases under the California Invasion of Privacy Act and other similar data privacy statutes challenging websites’ use of cookies, pixels, and similar tracking tools to track and share website visitors’ data to third parties,” noted David Anthony, a partner at Troutman Pepper Locke. “These cases show no sign of slowing in 2026.”

When it comes to the next potential battleground for CIPA claims, “how courts apply” both the statute and prior court rulings interpreting the law “to algorithmic and AI-driven technologies” will be the next major frontier to watch in the new year, said Anthony.
