“What Are the Elements of a State Attorney General Offensive and Defensive Strategy?”
Our panel will discuss offensive and defensive strategies that companies in heavily regulated sectors can use during matters involving State Attorneys General (AGs). Our panelists will explore proactive engagement with AGs, including participation in AG meetings, identifying thought leaders, and effectively communicating business models and compliance efforts; will discuss defensive strategies, such as identifying how to secure quick wins and when to encourage multistate formation; and tactics for unearthing AGs’ goals, the optimal timing for meetings with staff, and how to effectively use FOIA requests. The panel also will analyze how changes within AG offices can influence the direction and pace of an investigation or litigation.
