Deborah Kovsky-Apap, a partner in Troutman Pepper Locke’s Bankruptcy + Restructuring Practice Group, was quoted in the February 20, 2026 Law360 article, “The Rise Of ‘Good’ Forum Shopping In Global Bankruptcy.”

“It is forum shopping, but not in a pejorative sense,” said Deborah Kovsky-Apap, a partner at Troutman Pepper Locke LLP. “There are just things you can do in different jurisdictions that you can’t necessarily do here.”

“Judge Wiles was pretty frank that this was really form over substance,” Kovsky-Apap said. “It’s not like these restructurings are getting away with something. They are using tools available to them and passing muster under the fairness and public policy requirements of Chapter 15.”
