In situations where such a vulnerability exists, when one service provider has a bad day, “every one of their clients also has a bad day,” noted Jim Koenig, who leads the privacy and cyber practice at Troutman Pepper Hamilton Sanders LLP. He said there’s been “more and more scrutiny” by clients, private plaintiffs and regulators of third parties that offer technology and hosting services that impact multiple parties.

“The FTC is interesting in that, with the change in leadership, while the agency may bring fewer data privacy and security cases, there may be more antitrust and unbundling cases, as the FTC will have to find the right balance between the more traditional Republican laissez-faire approach to regulation and the growing emotions against BigTech,” said Koenig, of Troutman Pepper.
