  • Judge Boasberg’s market definition approach “probably gives some comfort to big tech companies,” said Bradley C. Weber, co-head of Troutman Pepper Locke LLP’s antitrust practice. If other courts follow his reasoning, Weber said, they’ll probably be less likely to find market power if they define markets more broadly.
  • Troutman’s Weber predicted that the RealPage settlement “will become the blueprint” for other algorithmic pricing practices, which have been targeted as price-fixing in a range of industries.
  • “It kind of creates a safe harbor,” Weber said; follow those proscriptions and you’re probably safe from a federal enforcement action.
  • “But if you stray outside of those boundaries,” especially if you’re using nonpublic data from rivals to set prices, “you’re at risk,” he said.
