The past several years have seen extensive developments in privacy protection. Several states have sought legislative solutions to privacy law concerns, and the impact of foreign privacy laws (such as the European Union’s General Data Protection Regulation) has become more strongly felt in the United States. Arguably the most comprehensive legislation – the California Consumer Privacy Act (CCPA) – is scheduled to become effective later this year, and its impact on lawyers and their clients nationwide is expected to be extensive. Privacy-related legal developments have also been accelerated by the COVID-19 pandemic. The legal profession is adapting to the use of new technology in the practice of law for a variety of tasks, forcing lawyers to consider their ethical obligations with respect to the use of technology and maintaining confidential information in a digital remote work environment.
