  • “It’s wanting the industry to flourish as a driver or a philosophy, versus the states [asking], ‘How do we regulate this in a way that’s thoughtful without killing the golden goose?'” said Ashley Taylor, a partner at Troutman Pepper Locke and co-leader of the firm’s state attorneys general practice.
  • “State AGs in particular have repeatedly said that the public debate is conflating AI regulation and existing consumer protection laws as applied to AI functions,” Taylor said. “Even if there is preemption relative to AI, that doesn’t prevent application of existing consumer protection laws to AI.”
  • “States are going to regulate AI, it’s just a question of whether they do it through the state legislature or through enforcement actions and state AGs,” Taylor said. “Even if a bill passed at the federal level, … there’s going to be a body of regulatory law developed, it’s just going to be developed in settlements and injunctive relief.”
