Brian H. Callaway

Brian represents clients at regional, national, and global corporations in connection with complex commercial litigation, internal investigations, and regulatory issues. He efficiently resolves disputes pre-litigation through advocacy and negotiation of favorable settlements. Brian also litigates a broad spectrum of individual and putative class-action claims, including alleged bad faith, professional negligence, and violations of federal and state statutes. He has experience protecting clients from intrusive discovery that threatens confidential or proprietary information, or is overly burdensome and expensive to produce, and guides clients in responding to subpoenas, civil investigative demands, and other requests from government agencies.

Brian also maintains an active pro bono practice, including helping to supervise firm-sponsored pro bono programs in partnership with both the Homeless Advocacy Project and the Transgender Legal Defense and Education Fund.

• Obtained victories for the insurer at both the motion to dismiss and summary judgment phases on statutory bad faith, breach of contract, fraud, and negligence claims in numerous cases.
• Secured a significant denial of class certification and grant of summary judgment in RICO litigation on behalf of a financial services company.
• Successfully defended two government agencies accused of constitutional and statutory violations, resulting in complete denial of application for injunctive relief.
• Second-chaired successful prosecution of breach of contract claims in arbitration, resulting in client’s recovery of both compensatory damages and attorneys’ fees.
• Counseled insurer on complex regulatory and coverage issues.
