Jim has more than 30 years of experience representing leading global businesses in high stakes business litigation. He has acted as lead counsel in numerous high profile and high exposure litigation matters in both trial and appellate courts throughout the U.S. Jim handles a wide variety of litigation matters, with a particular focus on antitrust, complex contract disputes, business torts, intellectual property, and fiduciary litigation. Jim has represented companies in a broad range of industries, including the media, sports, entertainment, manufacturing, and telecommunications industries.

  • Represented Turner Network Sales, Inc. in a breach of contract action against DISH Network, involving the distribution of CNN.
  • Represented the trustees of family trusts and directors of family corporations in litigation in which the plaintiffs alleged breach of fiduciary duties in the management of the trusts and family corporations, and sought hundreds of millions of dollars of damages. The litigation spanned over nine years and included multiple appeals to the Georgia Supreme Court and Georgia Court of Appeals on matters of first impression. The litigation was successfully resolved after a two and a half week jury trial.
  • Represented a multibillion dollar family corporation and its directors in shareholder litigation in which the plaintiffs alleged breach of fiduciary duties in the management of the corporation and sought damages of hundreds of millions of dollars. Obtained a summary judgment ruling in favor of the corporation and directors on all claims.
  • Represented Maryland and Virginia Milk Producers Cooperative Association, Inc. in an antitrust action against Dairy Farmers of America, Inc. (DFA), alleging violations of Section 2 of the Sherman Act and Section 7 of the Clayton Act in connection with DFA’s purchase of three dairy processing plants in North Carolina.
  • Represented Turner Broadcasting System, Inc. and Time Warner Inc. in a contract dispute with Fox Sports Net South involving the launch of the cable television network, Turner South.
  • Represented Reed Construction Data, a Reed Elsevier company, in a corporate espionage lawsuit against The McGraw-Hill Companies, Inc., involving claims of monopolization under Section 2 of the Sherman Act and unfair competition under the Lanham Act and state law.
  • Represented the North American Coca-Cola bottling system in a breach of contract action against its aluminum can sheet supplier.
  • Represented Cartoon Network, Inc. and Cable News Network, Inc. in separate putative class actions stemming from claims that content viewed on Cartoon Network and CNN mobile software applications violated the Video Privacy Protection Act.
  • Represented CertainTeed Corporation in antitrust class actions alleging price fixing in connection with the sale of building materials.
  • Represented Turner Broadcasting System, Inc. in a breach of contract action brought against MGM Domestic Television Distribution, Inc. involving claims of breach of a film licensing agreement.
