Penelope practiced business insolvency law emphasizing representation of non-debtors. Prior to retirement, her clients included secured creditors, landlords, buyers and sellers, and trade creditors, as well as other parties in interest affected by financial insolvency — whether in or outside of a bankruptcy case.
Penelope had a vibrant mediation practice, certified in 1995 through Pepperdine University’s Straus Institute of Dispute Resolution, as well as its Advanced Mediation Program completed in 1998. Since then, she mediated dozens of disputes involving real estate and commercial transactions, and fraudulent transfer and preference matters.
Her experience included receiverships, prejudgment remedies (writs of attachment, possession, turnover orders), wrongful foreclosure defenses, fraudulent transfer and preference litigation, enforcement of notes and guarantees, and obtaining injunctive and declaratory relief. Whether involving real estate matters or operating companies, Penelope’s practice included representation of lenders regarding adequate protection and cash collateral litigation, valuation issues, avoidance actions and plan confirmation disputes. Penelope practiced in local, regional and national matters in bankruptcy cases of all sizes.
