Our Media, Technology, and Cyber Liability Insurance practice provides comprehensive counsel and representation to insurers in complex coverage disputes. We assist clients with issues arising from loss of private data, electronic publishing errors, software implementation mistakes, telecommunications service delivery, consumer class actions, and regulatory investigations.

Our team has deep experience with traditional media and technology errors and omissions policies, as well as new forms and endorsements specifically addressing cyber risks. We frequently handle claims involving multiple types of coverage and numerous insurers and insureds, leveraging our extensive experience in complex insurance disputes to help clients successfully resolve even the most challenging matters.

We also utilize an interdisciplinary approach to navigate cyber and privacy insurance matters. Our group partners with global insurance clients to consider policy wording and potential cyber and privacy exposures under stand-alone cyber policies or endorsements, as well as under a variety of first-party and third-party policies, such as property, CGL, D&O, E&O, fidelity, and EPL. Our experience includes product development, risk management, and coverage work involving claims analysis, claims monitoring, litigation, mediation, and arbitration.

We counsel clients on how various jurisdictions have ruled or may rule on coverage issues affecting cyber and privacy insurers. Our advice is informed by our experience with cyber and privacy exposures and cyber and privacy policy wordings and risk.

Our team frequently speaks and writes on cyber and privacy risk management and insurance issues. We have been featured at conferences and webinars sponsored by organizations such as Advisen, Professional Liability Underwriting Society (PLUS), NetDiligence, the Association of California Insurance Companies, the International Association of Insurance Receivers, and the American Conference Institute. We also participate in internal education programs for insurers throughout the U.S., UK, and EU.

  • Represented a cyber-liability insurer in declaratory judgment litigation over coverage for data breach liability.
  • Advised a cyber-insurer regarding coverage for loss of private medical information and a related dispute between multiple carriers.
  • Represented a multimedia carrier in connection with the settlement of multiple class actions asserting liability for improper charges for cellular telephone content.
  • Represented an insurer in a dispute involving coverage pertaining to a copyright infringement suit, which involved allegations of unauthorized use of music in videos streamed over the internet.
  • Advised an insurer regarding coverage for a lawsuit brought by television personalities alleging the unauthorized use of their likenesses in video games.
  • Advised an insurer concerning a lawsuit between two internet-based companies alleging misappropriation of trade secrets and unfair competition.
  • Advised a media liability carrier regarding coverage issues and underlying exposure in multijurisdictional litigation against a publisher of package inserts for a prescription drug.
  • Assisted insurer clients in the development of cyber and privacy insurance products and programs.
  • Worked with clients on cyber and data-related wordings in other lines of policies, including E&O, technology, media, and game developer policies.
  • Assessed, negotiated, and litigated coverage issues for cyber, data, privacy, technology, and media risks and claims, including incident response, cybersecurity and privacy liability, regulatory proceedings, ransomware and extortion, malware and other system and network disruptions, wire transfer fraud, business email compromises, business interruption, data or system restoration, website or media content liability, and PCI DSS compliance.
