Sophisticated insurers rely on our extensive knowledge and experience to guide them on their most complex, high-value directors and officers (D&O) liability claims across a wide variety of areas, including securities, mergers and acquisitions, ERISA, antitrust, and bankruptcy. We help clients identify, evaluate, and allocate claims, and proactively and efficiently resolve disputes.
As part of the insurance + reinsurance group, we provide innovative and practical solutions that help clients anticipate and avoid risk. Our team handles a wide variety of complex claims involving directors’ and officers’ policies and related lines of coverage, representing clients in high-stakes lawsuits, regulatory investigations involving directors and officers of public and private companies, and complex claims involving financial institutions.
Our team has decades of complex securities experience. We were deeply involved in several significant securities cases, including Lehman Brothers and other subprime/credit crisis-related litigation, Madoff-related litigation, options backdating-related litigation, Enron, Tyco, WorldCom, HealthSouth, and IPO laddering. We draw from this experience to advise clients on underlying liability issues, such as analyzing exposures presented by the Securities Act, the Securities Exchange Act, the Sarbanes-Oxley Act, the Foreign Corrupt Practices Act, and similar statutes. We also closely examine damages and assess settlement valuation models to ensure our clients have every angle covered.
Our results-focused litigators handle complex insurance coverage litigation before federal and state trial and appellate courts, as well as arbitrations and mediations. We can often head off litigation before it begins. When litigation is unavoidable, we bring time-tested trial experience to reach the best possible outcome.
We provide clients with useful analyses of federal and state court cases that address a wide variety of coverage issues. Our annual publication, Professional Liability Year in Review, which highlights key decisions in nearly every U.S. jurisdiction regarding D&O and professional liability insurance coverage issues, is highly regarded and frequently referenced by our clients and industry professionals. Additionally, we continuously provide our clients with training and educational seminars that address a wide range of insurance industry topics.
Over the past year, federal and state courts across the U.S. have continued to reshape the landscape of professional liability insurance. From high-stakes coverage battles to nuanced interpretations of policy language, 2025 delivered a breadth of notable decisions addressing a wide variety of coverage issues that every insurer, broker, risk manager, and coverage practitioner needs to understand. In this report, we focus on topics we believe will remain important in the professional liability insurance field and hope you find the selection of cases both informative and helpful.
