As part of the insurance + and reinsurance group, our team helps insurers involved in the health care industry solve their complex challenges, ranging from regulatory, compliance, and claims litigation to privacy, cybersecurity, and transactional matters. We help clients identify potential exposures and resolve a wide range of disputes related to traditional quality-of-care issues to enforcement of anti-kickback, data privacy, and other laws and regulations.

With a significant track record in the health care and insurance sectors, we have handled high-exposure and high-risk malpractice claims against individual practitioners, groups, and hospital systems. Additionally, our directors and officers liability experience spans areas ranging from credentialing disputes to the alleged failures to implement appropriate training, policies, and procedures; cyber liability and data breach exposures; qui tam and whistleblower claims; regulatory issues, including recovery audit contractor audits and billing fraud; and antitrust exposures.

  • Represented a primary insurer with antitrust claims brought by the Federal Trade Commission, a state attorney general, and a private competitor concerning the acquisition of a physician practice by a hospital system.
  • Investigated and litigated potential rescission issues arising out of misrepresentations on policy applications.
  • Represented a carrier of an individual practitioner facing exposure in the largest case of sexual abuse involving minors outside of the clergy-abuse arena.
  • Represented a cyber-liability carrier for a hospital system that suffered theft of computers containing confidential patient records.
  • Assisted clients in assessing, developing, and implementing trial and resolution strategies for malpractice claims stemming from birth traumas, surgical errors, and “angel of mercy” incidents.
