We regularly advise clients on disputes involving large commercial and residential developments, Fair Business Practices Act compliance, easements, restrictive covenants, foreclosures, landlord-tenant issues, franchises, fraud, breach of contract, loan/financing disputes, real property receiverships, borrower/guarantor litigation, and bankruptcy.

Several key areas of our work include:

• Real Property Receiverships: Representing financial and lending institutions in obtaining receivership appointments to protect and preserve collateral in state and federal courts, including actions involving apartment complexes and residential subdivisions; suburban office and Central Business District office, retail, and lifestyle centers; hotels; multifamily projects; mixed-use projects; industrial projects; and other esoteric asset classes, such as golf courses and mobile home parks.
• Foreclosure Litigation: Representing servicers, trustees, and noteholders, including major national banks, in foreclosure litigation.
• Landlord-Tenant Litigation: Representing landlords and tenants in eviction actions and disputes over lease agreements in state and federal courts.
• Easements and Restrictive Covenants: Representing owners, developers, lenders, purchasers, and sellers in disputes over real estate contracts and governing documents in state and federal courts and arbitrations.
• Borrower/Guarantor Litigation and Bankruptcy: Representing financial institutions in actions against borrowers and guarantors concerning real estate secured loans, including defending against lender liability claims and assisting in asset investigations for litigation options.
