Practice
Drawing on our legal, regulatory, and scientific know-how, we find solutions to clients’ compliance, enforcement, remediation, and other environmental issues. From global corporations to individuals, we help clients contain and manage risk, facilitate deals, and protect their businesses. Our national team of environmental attorneys navigates the complex maze of rules associated with the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund), the Resource Conservation and Recovery Act (RCRA), and additional relevant laws and statutes.
What We Do
We routinely advise clients on the full range of issues related to contaminated property, including brownfields and voluntary cleanup programs, compliance matters, underground and aboveground storage tank management and remediation, and vapor intrusion. Purchasers, sellers, tenants, and investors rely on us to facilitate transactions involving contaminated properties throughout the U.S. Our Superfund-related experience includes allocation of response costs among potentially responsible parties (PRPs), scoping of site assessment, removal, and remedial actions.
Our team focuses on the strategic use of available grant and tax incentive programs, site investigations that support our clients’ specific objectives, assessment of regulatory and litigation risks, oversight of technical evaluations that characterize exposure pathways, and execution of remediation strategies that reinforce risk-based cleanup. We work on numerous brownfield, voluntary cleanup, and corrective action projects each year, enabling us to understand the regulatory framework in different states and develop close working relationships with consultants, regulators, and local project teams.
Transactional and Compliance Support
In our brownfields and urban redevelopment transactional work, we analyze environmental risks and allocation of liabilities in connection with the purchase, sale, and development of properties. We develop transactional structures and documentation to help reduce the potential for environmental liability. Our environmental attorneys represent a broad array of businesses in energy exploration and production, midstream, refining, mining, manufacturing, waste management, recycling, real estate development, transportation service, pulp and paper, oilfield services, food processing, and many other industries, as they address their responsibilities regarding response obligations, waste management, as well as discharge and emission of regulated materials, chemical management, and other related regulatory responsibilities.
We counsel clients on the contours of the law, providing options for new or different operational approaches to streamline and reduce waste management obligations, or to recycle, re-use, or monetize previously discarded material. Additionally, we work with clients to obtain waste-related permits or other authorizations and defend enforcement actions or other claims regarding waste management practices.
Who We Serve
Our clients include Fortune 100 corporations, general and limited partnerships, municipalities, lenders, fiduciaries, state quasi-governmental authorities, and individuals. We assist with cleanup actions in the majority of states and EPA regions, helping clients avail themselves of the liability protections and incentives offered pursuant to brownfields and voluntary cleanup programs.
Technical Knowledge
Our team includes attorneys with technical training and experience in chemical engineering, ecology, statistics, and water quality, including master’s and doctoral degrees in environmental science and engineering. Among our team are former EPA lead counsels for multiparty cleanups and former chiefs of hazardous waste law branches. This experience provides us with a deep understanding of the issues affecting our clients’ businesses and allows us to develop thoughtful and sophisticated responses to the environmentally sensitive issues our clients often face.
