Water Quality + Water Resources

Clients benefit from our in-depth understanding of the Clean Water Act (CWA) and our extensive experience with water-quality and coastal-development matters. We represent clients in all aspects of the CWA and analogous state laws, from concentrated animal feeding operations (CAFO) permitting to wastewater discharge, and management of waters of the United States and state waters. Our attorneys provide ongoing counsel throughout the country, advising on resource and systems planning, permitting, compliance, and litigation.

We handle permitting issues for utility companies, including National Pollutant Discharge Elimination System permits, permits for discharges of dredged and fill materials (CWA § 404 permits), and permits for surface water and groundwater withdrawals.

We assist clients with water supply issues, from resource management and systems planning to permitting, compliance, and litigation. We also have extensive experience negotiating groundwater purchase and sale agreements and surface water and treated water supply contracts.

Our practice covers matters arising under the CWA, the Safe Drinking Water Act, and other federal, state, and local environmental and land use laws. We also address and obtain regulatory closure for groundwater impacts associated with historical uses or recent releases, including PFAS issues.

We secure permits related to wetlands, soil and erosion control, and riverbank modification for numerous clients, including developers and banks.
