ITC Litigation

Litigation at the ITC requires legal counsel who understand the unique challenges and opportunities this important forum presents, along with the technical knowledge needed to present a compelling case. We represent clients before the U.S. International Trade Commission (ITC) with a deep understanding of the products and patents at issue.

Our practice is led by attorneys who previously worked at the ITC, and every member of our team has represented clients in multiple Section 337 investigations. We support clients throughout the entire process, from filing the complaint to the investigation’s conclusion, including representation in parallel proceedings before district courts and the Patent Trial and Appeal Board, and, if necessary, appeals to the Federal Circuit. Over the past decade, we have served as counsel on more than 30 Section 337 investigations and are well-acquainted with the ITC’s administrative law judges and staff attorneys.

Served as counsel to complainant on patent infringement claims against multiple respondents involving consumer electronics and video coding/compression technology. Obtained multiple favorable settlements.
  • 3842, Certain Smart Televisions – complaint filed August 3, 2025 – pending Institution. Represent complainant in investigation involving voice activated user interaction technology.
  • 337-TA-1438, Certain Photovoltaic Trunk Bus Cable Assemblies and Components Thereof. Represented complainant in investigation involving lead assemblies or trunk bus systems for connecting components in solar energy systems and solar panel arrays.
  • 337-TA-1148, Certain Integrated Circuits and Products Containing Same. Represented complainant in investigation involving design-for-manufacture technology for integrated circuits, resulting in favorable settlement.
  • 337-TA-1403, Certain Sensors with Pixels and Products Containing the Same. Represented complainant in investigation involving pixel isolation in image sensors. The case also involved parallel district court litigation. All cases resolved in favorable settlements.
  • 337-TA-1037 and 337-TA-1099, Certain Graphics Processors and Products Containing Same. Represented complainant in investigation involving graphics processing units, resulting in favorable settlement.
  • 337-TA-1107, Certain LED Lighting Devices and Components Thereof. Counsel to complainant Fraen Corporation regarding the infringement of patents for LED lighting and high-precision, high-efficiency color-mixing LED lighting optics. The action resulted in several companies entering licensing agreements for the technology, and the issuance of a general exclusion order blocking importation of goods infringing Fraen’s patented technology.
  • 337-TA-804, Certain LED Photographic Lighting Devices and Components Thereof. Counsel to complainant Litepanels in patent infringement claims involving LED photographic lighting devices. Obtained a general exclusion order prohibiting importation of infringing products.
  • 337-TA-1026, Certain Audio Processing Hardware, Software, and Products Containing the Same. Counsel for complainant Andrea Electronics Corporation, against respondents Apple and Samsung. Favorable settlements obtained as to most respondents before trial, and won recognition for the first time at the ITC that patent owners have standing even if litigation is funded by third party.
  • 337-TA-906, Certain Standard Cell Libraries and Integrated Circuits Made Using Same. Counsel to complainant Tela Innovations, Inc. asserting infringement claims involving patents for standard cells design and layout used in integrated circuits against respondents Taiwan Semiconductor Manufacturing Company Ltd. and TSMC North America, Inc. Obtained favorable settlement before trial.
  • 337-TA-1148, Certain Integrated Circuit Devices. Representing complainant Tela Innovations against semiconductor manufacturer and consumer electronics manufacturers on patents relating to integrated circuit layout and design.
  • 337-TA-726 and 337-TA-850, Certain Electronic Imaging Devices. Represented complainant FlashPoint Technology against consumer electronics manufacturers on patents related to digital imaging. 
  • 337-TA-873, Certain Integrated Circuit Devices. Represented complainant Tela Innovations against consumer electronics manufacturers on patents relating to integrated circuit layout and design.
  • 337-TA-949 and 337-TA-1026, Certain Audio Processing Hardware and Software. Represented complainant Andrea Electronics against PC and smartphone manufacturers on patents relating to digital audio signal processing. 
  • 337-TA-1334, Certain Raised Garden Beds and Components. In the Matter of Certain Raised Garden Beds and Components Thereof (U.S.I.T.C. and S.D.T.X.). Lead counsel for start-up complainant in an ITC investigation and district court litigation relating to raised metal garden beds, completed one-week trial, and obtained Commission Decision finding misappropriation of trade secret, obtaining limited exclusion, and cease and desist orders; filed subsequent enforcement proceeding and obtained settlement. The case was unusual because our client was able to establish the existence of an ITC “domestic industry” despite the fact that its own manufacturing takes place entirely in China and the products are not complicated to design, and also because almost all of the trade secrets in question had become public before the hearing.
  • 337-TA-1144, Certain Dental and Orthodontic Scanners and Software. Represented respondent in investigation involving intraoral scanners and graphics processing, resulting in finding by Commission of no infringement and therefore no violation of Section 337.
  • 337-TA-1140, Certain Multi-Stage Fuel Vapor Canister Systems and Activated Carbon Components Thereof. Counsel to respondents Kuraray Co., Ltd., Kuraray America, Inc., and Nagamine Manufacturing Co., Ltd., accused of infringing patents involving automotive emissions control systems. No violation was found and the decision was upheld on appeal to the Federal Circuit.
  • 337-TA-1090 and 337-TA-1091, Certain Color Intraoral Scanners and Related Hardware and Software. Represented respondent in investigation involving intraoral scanners and graphics processing, resulting in finding by Commission of no violation based on invalidity and non-infringement.
  • 337-TA-1025, Certain Silicon-On-Insulator Wafers. Co-lead counsel on behalf of Soitec, SA accused of infringing two patents silicon on insulator substrate manufacturing. Investigation terminated on favorable settlement.
  • 337-TA-966, Certain Silicon-On-Insulator Wafers. Co-lead counsel on behalf of Soitec, SA accused of infringing eight patents for silicon on insulator substrate manufacturing. Case dismissed by complainant after pretrial motion to strike domestic industry contentions granted.
  • 337-TA-948, In the Matter of Toy Figurines and Toy Sets Containing Same. Represented Canadian respondent in an investigation involving construction toy figurines and allegations of design patent and copyright infringement.
  • 337-TA-894, In the Matter of Certain Tires and Products Containing Same. Lead trial counsel for respondents South China Tire and Rubber Co., Ltd., et al. against Toyo Tire concerning the alleged infringement of design patents for vehicle tires. The case was settled favorably for our client.
  • 337-TA-876, In the Matter of Microelectromechanical Systems (“MEMs Devices”) and Products Containing Same. Represented a domestic complainant in an action involving microelectromechanical gyroscope technology for consumer electronics (e.g., smartphones).
  • 337-TA-843, In the Matter of Certain Electronic Devices Having a Retractable USB Connector. Lead Counsel for Office Depot Inc. who was accused of infringing a patent related to retractable USB drives; case successfully settled after motion for summary determination was defeated.
  • 337-TA-739, In the Matter of Certain Ground Fault Circuit Interrupters and Devices Containing Same. Lead counsel for respondent manufacturer in an ITC investigation relating to ground fault circuit interrupters; completed a two-week trial and obtained highly favorable final Commission order.
