Our labor and employment team partners with clients’ human resources professionals, in-house counsel, and managers, to address and resolve employment-related issues and prevent them from occurring, at every stage of the employment life cycle. We provide candid, pragmatic advice designed to help companies manage their legal obligations, promote efficiencies, and reduce the risk of legal challenges.
Internal Investigations: When an employee brings an internal complaint of harassment, discrimination, retaliation or similar issues, we partner with the client’s human resources or general counsel to address the issue. Sometimes, we simply advise the client’s internal team on the investigation process, while other times, we handle the investigation ourselves or retain a third-party to investigate and issue a report. In all instances, we strive to balance the need to conduct a full investigation and take appropriate action with the practicalities of running the business.
Day-to-Day Counseling: We offer strategic and practical solutions for complex employee issues, including performance management, workplace accommodations, leave issues, compensation, and the intersection of employee health and employment law matters.
Compliance Assistance: We assist with compliance in areas such as wage and hour issues, harassment, discrimination and retaliation complaints, leave of absence requests, reductions-in-force (RIFs) and corporate restructurings, union avoidance, privacy, discipline and discharge of employees, affirmative action, and safety and health regulations.
Audits and Reviews: We conduct audits of human resources practices and policies, including employee classifications, compensation systems, employee handbooks, I-9 forms, personnel files, and affirmative action plans. We help clients implement new approaches that balance legal compliance with business needs.
Agreements with Employees: We draft and negotiate employment agreements, separation agreements, and retention agreements, as well as restrictive covenants agreements that include noncompete, non-solicitation, and non-disclosure provisions. We also regularly advise employers on the enforceability of restrictive covenant provisions – both those that apply to their current employees and those that apply to candidates they would like to hire.
Policies and Procedures: We help clients implement effective and legally compliant hiring procedures, onboarding documentation, hiring screens, use of artificial intelligence, personnel policies, employee handbooks, and human resources procedure manuals.
Training Programs: We provide targeted training for clients’ managers, human resources personnel or even entire workforces on a variety of employment-related topics including avoiding discrimination and retaliation, preventing harassment, promoting diversity, protecting trade secrets and confidential information, complying with affirmative action obligations, hiring, discipline and termination, handling employee medical issues or leave requests, complying with wage and hour laws, and avoiding unionization.
Employee Separation: We guide employers through the employee separation process, addressing legal aspects of misconduct, poor performance, layoffs, and early retirement programs, including compliance with non-discrimination issues and layoff notice requirements.
