Bill Derasmo’s practice is focused on the representation of energy companies before the Federal Energy Regulatory Commission (“FERC”). For 20 years, Bill has represented electric utilities and other interested parties in virtually all aspects of matters before FERC, including enforcement proceedings, asset transfer applications, formal complaint proceedings, regional energy market formation, market-based and cost-based rate filings and disputes and multi-party settlements. Bill also has extensive experience in proceedings before state commissions dating back to his work as Assistant Counsel with the New York Public Service Commission (PSC) in the late 1990’s. He received his B.A. from Colgate University and his J.D. from Wake Forest University School of Law.

Representative Matters

Federal Energy Regulatory Commission

  • Represented energy storage/grid scale battery owner in groundbreaking FERC complaint against RTO.
  • Represented several companies in successful FERC proceedings against RTOs.
  • Successfully defended Midwest utility in complaint proceeding involving the right to develop a 765 KV transmission project.
  • Obtained FERC approvals for transmission rate incentives and the use of "forward-looking" formula rates.
  • Represented utility in regional capacity auction proceedings.
  • Counsel to utility purchasing capacity on merchant transmission line connecting two regional markets.
  • Represent developer of major Midwest transmission project designed to deliver wind and other renewables to the Midwest market.
  • Counsel to utility in successful declaratory action to protect grandfathered transmission rights.
  • Counsel to transmission-only company in Section 206 rate complaint where complaint was summarily dismissed.
  • Counsel to Midwest utility in inter-regional (or “inter-RTO”) transmission rate design and cost allocation proceedings.
  • Counsel to Midwest utility in regional (RTO-wide) transmission rate design and cost allocation proceedings.
  • Counsel to Midwest utility on “Attachment O” transmission cost-of-service formula rate case.
  • Counsel to Midwest utility regarding revenue sufficiency guarantee payment proceedings.
  • Counsel to Midwest utility in proceeding to establish “Day 2” LMP markets and “Day 3” Ancillary Services co-optimized LMP markets.
  • Counsel to several utilities regarding RTO formation and participation.
  • Counsel to utilities exiting or analyzing exit-from-RTO options.
  • Counsel to utility divesting its transmission system in order to create an independent “transco”.
  • Counsel to utilities regarding resource adequacy and capacity market proceedings in New York, New England, California and the Midwest.
  • Counsel to several utilities and independent generators with respect to market rules and market development in the restructured New York ISO, California, ISO, Midwest ISO and PJM markets.
  • Counsel to utility regarding FERC Fuel Adjustment Clause regulations and practices.
  • Have represented numerous companies in bilateral or multi-party settlements approved by FERC.
  • Counsel to generators and utilities in proceedings involving RTO demand response mechanisms.
  • Counsel to transmission providers regarding tariff compliance and open access compliance issues.
  • Represented State of New York in proceedings to establish the New York ISO and related matters.
  • Appellate counsel to several clients in appeals of FERC orders.

New York

  • Counsel to municipality in HVDC transmission siting case.
  • Counsel to independent electric generator in complaint proceeding against gas distribution company.
  • Counsel to independent generator acquiring hydro and gas turbine assets.
  • Counsel to competitive telecommunications provider in pole attachment/conduit rate complaint before New York Public Service Commission.
  • Assistant Counsel to New York Public Service Commission 1997-1999; represented Staff in various proceedings related to electric, gas and water.

Georgia

  • Advised large Southeastern utility regarding its 2007 Integrated Resource Planning Case.
  • Advised large Southeastern utility regarding the promulgation of ex parte rules for state commission proceedings.

Indiana

  • Provided strategic advice to utility regarding the recovery of federally-imposed costs through retail rates.
  • Advised utility regarding coordination of federal and state smart grid initiatives and demand response.

Maine

  • Advised Maine utility in proceeding evaluating whether utility should maintain RTO membership or depart ISO New England.

International

  • Through USAID sponsored programs, advised Romanian authorities regarding restructuring of electric utility industry, privatization of state run assets and maximizing the efficiency of transmission assets.

Public Power

  • Counsel to large integrated Midwestern public power entity providing day-to-day counsel on wide range of FERC compliance issues.
  • Counsel to large integrated Midwestern public power entity regarding reciprocity open access issues.
  • Advised large Northeastern public power entity regarding standards of conduct compliance.

Telecommunications

  • Counsel to large New York municipality in cable franchise negotiations.
  • Counsel to large New York municipality in negotiation of right-of-way agreement with distributed antenna system (DAS) provider (including access fee and other compensation arrangements).
