NEW YORK – A Troutman Pepper Locke Appellate, Supreme Court, Election Law and Redistricting team secured a significant victory on March 2, when the U.S. Supreme Court granted an emergency stay application on behalf of Congresswoman Nicole Malliotakis and several supporting voters in a high-stakes redistricting challenge involving New York’s 11th Congressional District.
The Supreme Court’s order blocks a state trial court ruling that had required the district’s boundaries to be redrawn and keeps in place the existing district lines.
Following a four-day trial, the state court concluded that the district’s configuration was unlawful and ordered that new boundaries be developed through the state’s redistricting process. Troutman Pepper Locke moved swiftly to develop and execute the Congresswoman’s appellate and Supreme Court strategy, arguing that the court-ordered changes raised serious federal constitutional concerns and threatened to create significant uncertainty for upcoming elections.
Over a period of less than three months, the firm’s cross-office team, drawing on its Election Law and Redistricting practice, built a comprehensive trial record in this jurisdiction and pursued fast-moving relief across multiple courts. The team filed emergency stay applications in the New York Court of Appeals, the New York Appellate Division, and ultimately the U.S. Supreme Court.
The Supreme Court’s order preserves the current map for New York’s 11th Congressional District, maintaining the Staten Island–Brooklyn configuration.
Obtaining a stay of a trial court order from the U.S. Supreme Court is exceedingly rare and underscores the significance of the ruling, as well as Troutman Pepper Locke’s experience handling complex, time-sensitive election and constitutional matters across multiple judicial forums.
