Josh Kaplowitz, counsel in Troutman Pepper Locke’s Renewable Energy Industry Group, was quoted in the November 3, 2026, Bloomberg Law article, “Democrats Seek Wind Project Certainty Ahead of Permitting Vote.”

  • The permitting bill’s certainty provision would bar agencies from delaying decisions past statutory deadlines without “clear and convincing evidence,” or claw back project approvals except for limited circumstances, like contract breaches or national security threats. These higher standards are needed after the Trump administration’s efforts to sit on offshore wind applications and disrupt final approvals, said Josh Kaplowitz, an attorney at Troutman Pepper Locke.
  • “Now we have this precedent set with offshore wind we have to grapple with,” Kaplowitz said. “Half of why we have these provisions in the permitting reform bill is to solve a problem that primarily flared up in the past two years.”
